Federal Criminal Investigation

Finding yourself under investigation for an alleged federal offense can be the most stressful time in your life. Although the federal government generally follows the same process when investigating an individual suspected of criminal activity, initial contact can occur in many different ways. In some cases, you may receive a telephone call from a federal law enforcement agency like the FBI indicating that they "just want to ask you a few questions." Under other circumstances, you may receive written communication in the form of a "target" letter which means the government may be close to indicting you for specific charges. This generally depends upon the status of the investigation and the extent of information that the government already has.

Whether by letter, telephone call or personal visit, the initial contact between you and the federal government is a very critical stage of the proceedings. Federal law enforcement agents are well trained and experienced in eliciting conversation from people who really should not talk to them. Although the Constitution guarantees your right to have a lawyer present during custodial questioning, you need to "invoke" this right in order to be entitled to those protections. When the time comes to challenge the admissibility of any statements you may have made, the Court may decide that general, conversation questions or statements such as: "Maybe I should talk to my lawyer..." or "Do I need a lawyer?" are not definite enough to stop the questioning. If you are ever contacted by federal law enforcement agents, the most important thing that you can do is firmly, but politely decline any request or invitation to "answer a few questions" without your lawyer present. Period.

Too many times, people think that they can "talk" their way out of what ever problems they face. They think that they can sufficiently "explain" themselves during what feels like a casual conversation and convince the agents to direct their investigation elsewhere. Unfortunately, federal agents are allowed to engage in deception, trickery and even outright lie to a suspect during their investigation. That's why attempting to literally "represent yourself" during this critical phase of the process is so risky. You may be providing an answer to a question that has no basis in fact. Your answer may point agents in a direction they were previously unaware of. Additionally, there is no way to predict or control what context or interpretation the agents may apply to your "innocent" sounding statement.

The best advice available is to be polite, be firm, and do not speak with the agents unless you have competent federal criminal counsel present.
